Terms & Conditions

These terms govern your use of this website and describe the basis on which mWealth provides its services.

Website terms, not your client agreement

The terms below apply to this website and to the general basis of our services. The binding commercial terms of any account — profit-share percentage, risk profile, reporting cycle and termination — are set out in the individual agreement you sign before trading begins. Where the two differ, your signed agreement prevails.

1. Acceptance

By accessing this website you accept these terms. If you do not accept them, please do not use the site. We may update these terms from time to time, and the version published here is the one in force.

2. Nature of our services

mWealth provides trading management, algorithmic trading and trading support services, and introduces clients to third-party brokers. We are not a bank, a deposit-taking institution, a custodian or a broker. We do not accept, hold or control client funds at any time.

3. Eligibility

You must be of legal age in your jurisdiction and legally permitted to trade leveraged foreign exchange and commodity products there. You are responsible for ensuring that using our services is lawful where you live. We may decline to act for any person or in any jurisdiction, at our discretion and without giving reasons.

4. Your account and your capital

Trading accounts are opened in your own name with a partner broker, funded by you directly, and remain under your ownership and control throughout. Where you grant mWealth trading authority, that authority permits the opening and closing of positions only. It confers no right to withdraw, transfer or otherwise deal with your money. You may revoke it at any time through your broker.

5. Fees

Managed and algorithmic accounts operate on a profit-sharing basis. The percentage and the calculation period are agreed in writing before trading starts. Losses carry forward, meaning a shortfall must be recovered before any further profit share is charged. For self-trading clients, mWealth receives a volume-based rebate from the broker; this does not alter the spread or commission you pay to the broker.

6. Introducers

Our referral programme operates on a single tier. Introducers are paid a share of revenue generated by accounts they introduce directly. No commission is payable on introductions made by other people, and no payment is made for recruitment of any kind. Introducers must not promise returns, give investment advice, or handle client funds; doing so terminates the agreement immediately.

7. Risk

Trading carries a substantial risk of loss and no return is guaranteed. You accept that losses may occur and that they are borne by you as the account holder. Please read our Risk Disclosure, which forms part of these terms.

8. No advice

Content on this website and communications from our staff are general information only. They are not investment, legal or tax advice and do not take account of your individual circumstances. You are responsible for your own decisions, including the decision to grant or revoke trading authority.

9. Accuracy of information

We take care to keep this site accurate and current, but we do not warrant that it is free from error or omission. Figures used in illustrations are exactly that — illustrations — and should not be relied upon as representative of any account.

10. Intellectual property

The content, design, trading tools and indicator suite made available through mWealth remain our property or that of our licensors. You may use them for your own trading while you are a client. You may not resell, redistribute or publish them.

11. Your information

Information you submit through this website is used to respond to your enquiry and to administer your relationship with us. Broker onboarding requires you to provide identification documents directly to the broker under their own verification and privacy processes. We do not sell your personal information.

12. Third-party services

Brokers, platform providers and payment processors are independent third parties operating under their own terms. We select partners carefully but are not responsible for their acts, omissions, outages or solvency.

13. Limitation of liability

To the extent permitted by law, mWealth is not liable for trading losses arising from market movement, for losses caused by third-party platform or broker failure, or for indirect or consequential loss. Nothing in these terms excludes liability for fraud or for anything that cannot lawfully be excluded.

14. Termination

Either party may end the arrangement at any time. You do so by revoking trading authority with your broker. On termination, any profit share already accrued remains payable, and your account and its balance stay entirely with you.
